Consent and Variations
Consent: By accessing and/or using our Site and Services, you agree to these terms and our Privacy Policy (Terms). Please read these Terms carefully and immediately cease using our platform if you do not agree to them.
Variations: We may, at any time and at our discretion, vary these Terms by publishing the updated version on our Site. We recommend checking the Site regularly to ensure you are aware of our current terms.
SaaS Services and License
The Service: RSA Malaysia provides a B2B SaaS medium to facilitate roadside assistance (RSA) services, including towing, fuel top-up, battery jumpstart/replacement, tire replacement, and locksmith services.
License to Use: We grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable license to use our Site and API in accordance with these Terms.
Intellectual Property: RSA Malaysia owns all Intellectual Property Rights, including copyright in the Software, the SaaS interface, and any documentation provided. You must not copy, reproduce, or circulate any Content without our prior written consent.
Account and Credit System
Registration: Account registration is free of charge for eligible B2B partners (Insurers, Fleet Managers, Workshops, and Super-app Owners).
Credit Wallet: The platform operates on a prepaid credit model. RM 1.00 is equal to 1 Credit.
Non-Refundable: All credits topped up into the account are strictly non-refundable and non-transferable to other accounts.
Sufficient Funds: Partners must ensure their credit balance is sufficient to cover the base price of a service before creating an order.
Partner Markup and Profitability
Markup Rights: Partners are permitted to markup the base price of services offered via the platform.
Profit: The difference between the Partner’s retail price to the end-consumer and the RSA Malaysia base price constitutes the Partner’s profit.
Taxation: The Partner is solely responsible for all tax obligations (including SST) and billing accuracy arising from their own markup.
Cancellation and Penalty Policy
To compensate service providers for mobilization, fuel, and time:
- The 15-Minute Rule: A cancellation window of 15 minutes is provided from the moment a service provider (rider/tow truck) has been assigned/enforced.
- Automatic Deduction: Cancellations made after 15 minutes of provider enforcement will result in a mandatory deduction of 30 Credits from the Partner’s account balance.
Prohibited Conduct and Termination
Lawful Use: You must not use the Site for any unlawful purpose or to facilitate third-party violations of privacy.
Competition: You are prohibited from using our Site or Content in any way that competes with our business.
Termination: These Terms are effective until terminated by us. In the event of termination, your access will be revoked, but all restrictions and limitations of liability set out in these Terms will survive.
Data Privacy (PDPA)
Compliance: We handle all personal data in accordance with the Personal Data Protection Act (PDPA).
Data Minimization: We only process and share the minimum data necessary (e.g., vehicle plate, location) to fulfill the roadside service request.
Security: Partners must ensure that any end-user data they transmit to the platform is done so with the necessary consents.
Limitation of Liability and Indemnity
Service Facilitator: RSA Malaysia acts as an intermediary. To the maximum extent permitted by law, we are not liable for physical damages to vehicles during service or indirect business losses due to service delays.
Indemnity: You must indemnify us and hold us harmless against any liability or loss arising from your use of the Site or breach of these Terms.
